On October 5, 1992, at approximately 3:30pm the undersigned was part of a raiding party executing Prosecutors search warrant #74-92 at 50 Columbia Ave., 6th Floor, Newark, N.J. During the course of this investigation the undersigned did have an occasion to shoot, a doberman Pinscher vicious guard dog. Original entry was made into the premises at approximately 1:30pm and the arresting targeting Narcotics Control, for narcotic and weapons charges, was allowed to secure his three guard dogs in bathroom areas. At the aforementioned time duty of Newark dog handlers arrived to remove the animals when during the course of their duties the above mentioned dog broke free from their custody. This dog proceeded to charge at Det. G. Vickers (Newark PD) in an aggressive manner. Det. Vickers fired three shots into the dog and the dog fell to the ground near the undersigned. The dog was attempting to get back onto his feet and the undersigned fired one round into the head area of the dog, for the safety of the detectives spotting this dog to attack.
