US Copyright filing – Case #: 1-15081157241 Title: Nancy Mace Feb 10 2024
Although the photograph was first published in February 2024, the Copyright Act does not bar the copyright owner from filing a federal infringement action in 2026 so long as the owner has satisfied the registration prerequisite. Under 17 U.S.C. § 411(a), “no civil action for infringement of the copyright in any United States work shall be instituted” until registration is made, and the Supreme Court has confirmed that this requirement is met only after the Copyright Office acts on the application (i.e., registration is granted or refused). Fourth Estate Pub. Benefit Corp. v. Wall-Street.com, LLC, 586 U.S. ___ (2019). Once that prerequisite is satisfied, the owner may sue for infringement and seek injunctive relief and monetary remedies, including actual damages and the infringer’s profits under 17 U.S.C. § 504(b), subject to the three-year limitations period in 17 U.S.C. § 507(b) and the separate-accrual/three-year lookback principles recognized in Petrella v. Metro-Goldwyn-Mayer, Inc., 572 U.S. 663 (2014). The fact that registration was not made within three months of first publication (17 U.S.C. § 412(2)) generally limits only the availability of statutory damages and attorney’s fees for infringement that commenced before the effective date of registration, but it does not preclude suit itself nor preclude recovery of actual damages and profits. 17 U.S.C. § 412; 17 U.S.C. § 504(b).
